Official Statement: Zero Tolerance for Fake, False and Fraudulent Claims Against Our Brand
At RestoreX360/UQuick Technologies India Limited, we have built our reputation on the principles of quality, transparency, and integrity. Our commitment to serving our customers with excellence remains steadfast, and we take any attempt to harm our brand or mislead the public very seriously.
Recently, we have become aware of malicious activities involving the spread of false, fake, and fraudulent information about our company, products, and services. These baseless allegations are designed to tarnish our reputation and deceive consumers, which is unacceptable and in direct violation of Indian law.
Legal Framework Addressing False and Fraudulent Claims
Under Section 2(28) of the Consumer Protection Act, 2019, spreading false or misleading information about a product or service qualifies as a “misleading advertisement.” The Central Consumer Protection Authority (CCPA), established under Section 10, has the authority to take strict action against such violations. Further, Section 89 of the Act provides for significant penalties for such activities, including monetary fines and other legal consequences.
Additionally, under the Indian Penal Code (IPC), the dissemination of fraudulent or defamatory statements falls under Section 499, which covers “Badnakshi.” This section explicitly states that anyone who makes a false statement with the intent to harm another’s reputation is committing a punishable offense.
Demand for Action and Compensation
To those involved in the dissemination of fake, false, or fraudulent claims about RestoreX360 or UQuick Technologies India Limited, we demand the following:
- Cease and desist immediately from all such actions.
- Issue a formal retraction and public apology for the harm caused.
- Pay compensation of INR 100 crores (one hundred crores), equivalent to 1 billion INR, to UQuick Technologies India Limited for the significant reputational and financial damages caused.
Failure to comply with these demands will result in immediate legal action under the Consumer Protection Act, 2019, the Indian Penal Code, and other applicable laws. Legal proceedings will be pursued in the Rajkot Judiciaries, Gujarat, India.
